This volume contributes to the ongoing interdisciplinary controversies about the moral, legal and political status of children and childhood. It comprises essays by scholars from different disciplinary backgrounds on diverse theoretical problems and public policy controversies that bear upon different facets of the life of children in contemporary liberal democracies. The book is divided into three major parts that are each organized around a common general theme. The first part (“Children and Childhood: Autonomy, Well-Being and Paternalism”) focusses on key concepts (...) of an ethics of childhood. Part two (“Justice for Children”) contains chapters that are concerned with the topics of justice for children and justice during childhood. Drawing on a landscape analysis of existing data-sharing initiatives, in-depth interviews with expert stakeholders, and public deliberations with community advisory panels across the U.S., we describe features of the evolving medical information commons. We identify participant-centricity and trustworthiness as the most important features of an MIC and discuss the implications for those seeking to create a sustainable, useful, and widely available collection of linked resources for research and other purposes.

Cook (1995) criticized Kosslyn, Chabris, Marsolek & Koenig's (1992) network simulation models of spatial relations encoding in part because the absolute position of a stimulus in the input array was correlated with its spatial relation to a landmark; thus, on at least some trials, the networks did not need to compute spatial relations. The network models reported here include larger input arrays, which allow stimuli to appear in a large range of locations with an equal probability of being above (...) or below a “bar,” thus eliminating the confound present in earlier models. The results confirm the original hypothesis that as the size of the network's receptive fields increases, performance on a coordinate spatial relations task (which requires computing precise, metric distance) will be relatively better than on a categorical spatial relations task (which requires computing above/below relative to a landmark). Cook (1995) criticizes the work of Jacobs and Kosslyn (1994) on spatial relations, shape representations, and receptive fields in neural network models on the grounds that first‐order correlations between input and output unit activities can explain the results. We reply briefly to Cook's arguments here (and in Kosslyn, Chabris, Marsolek, Jacobs & Koenig, 1995) and discuss how new simulations can confirm the importance of receptive field size as a crucial variable in the encoding of categorical and coordinate spatial relations (...) and the corresponding shape representations; such simulations would testify to the computational distinction between the different types of representations. The work is a series of sharp, deep discussions by one great philosopher of the work of another. Leibniz's references to his contemporaries and his discussions of the ideas and institutions of the age make this a fascinating (...) and valuable document in the history of ideas. The work was originally written in French, and the version by Peter Remnant and Jonathan Bennett, based on the only reliable French edition (published in 1962), first appeared in 1981 and has become the standard English translation. Les etudes leibniziennes consacrees au droit positif, telles que le De Conditionibus de 1665, sont encore mal connues pour des raisons d'accessibilite et de complexite. En effet, ecrites en latin, impregnees de references prelevees dans le Corpus justinien (Digeste, Codex et Institules) ou dans le Droit Canonique (Decretales et Extravagantes) et souvent hermetiques dans leur abstraction apparente, elles ont ete delaissees au profit des reflexions jusnaturalistes dont la lecture ne semblait pas requerir les competences d'un juriste et encore moins celle (...) d'un romaniste. Mais on a ainsi occulte des travaux qui representent un apport essentiel pour toute philosophie pretendant depasser l'utilisation superficielle des principes du Droit Naturel dans la question du fondement des legislations positives. Et l'on s'est prive, sans le savoir, des moyens techniques de reconnaitre les diverses manifestations d'une raison commune dans le detail du systeme des obligations conditionnelles. Bien plus, on a totalement meconnu la vigueur et l'actualite d'une enquete portant sur les conditions de validite des dispositions juridiques affectes d'une modalite et soulevant en definitive ces questions esentielles que sont la constituion d'une theorie generale des conditions juridiques, la rationalisation du Droit et les limites de son traitement deductif. Gottfried looks at Schmitt as a critic of modern liberalism and as a defender of the national state who carefully examined Western historical and political traditions. Challenging the view that Schmitt was a mere polemicist who set out to subvert "German Democracy", Gottfried's work argues instead, that Schmitt criticized liberal democracy from a highly liberal reflective position that combined analytical depth with staggering erudition. We want to defend three claims: Firstly, we will argue that children’s vulnerability is best understood as a dynamic quality, meaning that as children progress through childhood, their vulnerability also undergoes particular changes. To capture this, we want to discriminate among physical, mental, social, and symbolic vulnerability, which vary according to certain features, such as age, maturity, gender, and (...) race. These different traits are furthermore important in order to understand what we owe children from an ethical perspective. In a nutshell, children have moral claims not to be harmed and to be protected against threats to their well-being and well-becoming, and these claims have to be explicated via the dynamic vulnerability of children. Finally, we will argue that one of the main issues is to balance the protection of children and their autonomy claims, which both enhance and diminish their vulnerability. | : Cet article examine la vulnérabilité particulière des enfants d’un point de vue éthique. Nous défendrons trois thèses. The ‘mineness’ of thoughts has often been accepted as indubitable in philosophy. However, the symptom of thought insertion in schizophrenia seems to be an empirical counterexample to the dictum that every introspected thought is one's own. We present a thorough conceptual analysis of mineness of thought, distinguishing between ownership and authorship . We argue that it is indeed a conceptual truth that introspected thoughts are owned by the introspector. However, there are everyday and pathological cases of thoughts, for which we (...) do not ascribe authorship to ourselves. To explain inserted thoughts, however, we need an additional factor which is constituted by the lack of control over inserted thoughts . We present a review of empirical data on thought control and thought insertion in the light of the conceptual analysis. We conclude with a summary of the most important future direction of research. Can the risks of the scientific technical world be sufficiently delimited in a normative sense? The answer provided by this article is yes, assuming that the potentials of negligence liability are clarified and its principles consistently applied. An outline of the basic conditions for this endeavor proceeds from the distinctions drawn by the Analytical Theory of Action. "Negligence" is defined as taking risks beyond normative limits. It is treated on this basis as the generic concept for "intention". A normative theoretical (...) justification of "required care" is proffered. The care required is limited, however, on the one hand by its tie to the norm addressee's practical ability. On the other, it is elevated by the consistent, non-random designation of norms on risk-taking and by the systematic inclusion of the ability to have been addressed normatively at an earlier point in time. The question as to whether one can locate responsibility sometime prior to the harm accidentally caused will be discussed and affirmed. The history of concepts is relevant in philosophy because conceptual distinctions fundamentally shape cognition. Because these conceptual distinctions are deeply entrenched in our way of thinking, we are not usually aware of this influence. How we view the world depends crucially on the concepts we have. These concepts, however, are the products of their history. Following Herbart, Gustav Teichmüller viewed philosophy as the systematic analysis and refinement of concepts. Refining concepts in such a way allows us to make new distinctions, (...) or to transform or abandon old ones. In contrast to Herbart, Teichmüller emphasized that this process presupposes detailed historical studies. This does not mean, however, that Teichmüller embraced a kind of historicism---the view that philosophy and its history are one and the same thing. On the contrary, he derogatorily referred to such a view as "historical psychology". Rather, the history of concepts in Teichmüller's sense has to be understood as a history of problems which are reflected in conceptual distinctions. This means that the history of concepts, which brings to light explicit and implicit distinctions, can be applied as a kind of hermeneutics of world views---as the basis on which we can systematically reconstruct concepts in a new light. It is the aim of this presentation to unfold such an understanding of the history of concepts in view of Teichmüller's contribution to it. (shrink)

Hugh Murray's comments on the civil rights movement recall Marge Schott's badly received observations on the Nazi regime. Murray is also describing something that turned out badly but which he insists began well. Contrary to Murray and Dinesh D'Souza, whose book he reviews, the continuities of the Civil Rights Movement and affirmative action policies are more significant than its alleged turning points. Affirmative action as a practice goes back to the last year of the Johnson administration, but some civil rights (...) leaders supported it before. As early as 1965, Martin Luther King, Jr., whom D'Souza elevates to a cultic figure, advocated the preferential treatment of blacks under a vastly expanded state apparatus. (shrink)

The enduring influence of the architect Gottfried Semper derives primarily from his monumental theoretical foray Der Stil in der technischen und tektonischen Künsten, here translated into English for the first time. A richly illustrated survey of the technical arts, Semper's analysis of the preconditions of style forever changed the interpretative context for aesthetics, architecture, and art history. First published in 1961, An Introduction to General Metaphysics presents Gottfried Martin's careful study of many of the passages in Plato and Aristotle which deal with metaphysical problems and in particular with the Platonic Theory of Ideas. He has traced the development of the theory both in early works and in late works such as the Parmenides and the Sophistes; and with equal care he has studied the relative passages in Aristotle's Metaphysics. He has quoted many of these passages (...) at length and has offered a careful account and analysis of the progress of Plato's thought. He has also discussed in a very interesting way the main passages relative to Aristotle's criticism of Plato's Theory of Ideas. Rick Johnstone's plea for liberal federalism and a supranational mechanism for enforcing “human rights” is reminiscent of what Thomas Hobbes said about “Christian commonwealths.” Behind their appeal to universal morality and religious doctrine was the frenzied attempt to shift rule “from Christian kings and sovereign assemblies absolute in their own territories” to “one Vicar of Christ, constituted of the universal church, to be judged, condemned, or deposed, or put to death as he shall think expedient, or necessary, for the common (...) good.” Johnstone is proposing or justifying a similar shift of authority for existing sovereign states to self-appointed vicars of…. In this paper, I present an analysis of the “windows into reality” that are used in theories of global justice with a focus on issues of epistemic injustice and the powerlessness of the global poor. I argue that we should aim for a better understanding of global poverty through acknowledging people living in poverty as epistemic subjects. To achieve this, we need to deepen and broaden the knowledge base of theories of global justice and approach the subject through methodologies of (...) “thinking small” and “thick descriptions”, which are ways to give people living in poverty sufficient room to express themselves and have their voices heard, leading to “small” and “thick” knowledge claims. This is the only work to provide a histori­cal account of Kant’s theory of arith­metic, examining in detail the theories of both his predecessors and his successors.

In recent years, it has been acknowledged increasingly that the relationship between analytic and continental philosophy is one of complementarity rather than opposition, as previously often assumed. In this essay I will argue that, in fact, early analytic philosophy has its roots in the tradition of continental philosophy. The essay will focus on Hermann Lotze's influence on Frege and on Frege's relationship to the Neo‐Kantians Otto Liebmann and Wilhelm Windelband. It will provide new evidence for the claim that Frege's philosophy (...) should be seen as belonging to the tradition of Neo‐Kantianism and, along the way, exhibit the continental roots of Frege's context principle. Leibniz's political and ethical writing long has been neglected, and with this new edition Professor Riley makes available the most representative pieces from Leibniz's political theory. This new edition, specially prepared for this series, is the first to make a considerable number of Leibniz's writings available in English, and includes three previously unpublished manuscripts, a selection of political letters, an introduction, notes, and a critical biography.

The selections contained in these volumes from the papers and letters of Leibniz are intended to serve the student in two ways: first, by providing a more adequate and balanced conception of the full range and penetration of Leibniz's creative intellectual powers; second, by inviting a fresher approach to his intellectual growth and a clearer perception of the internal strains in his thinking, through a chronological arrangement. Much confusion has arisen in the past through a neglect of the develop ment (...) of Leibniz's ideas, and Couturat's impressive plea, in his edition of the Opuscu/es et fragments (p. xii), for such an arrangement is valid even for incomplete editions. The beginning student will do well, however, to read the maturer writings of Parts II, III, and IV first, leaving Part I, from a period too largely neglected by Leibniz criticism, for a later study of the still obscure sources and motives of his thought. The Introduction aims primarily to provide cultural orientation and an exposition of the structure and the underlying assumptions of the philosophical system rather than a critical evaluation. I hope that together with the notes and the Index, it will provide those aids to the understanding which the originality of Leibniz's scientific, ethical, and metaphysical efforts deserve. (shrink)

Child poverty is one of the biggest challenges of today, harming millions of children. In this book, it is investigated from a philosophical social justice perspective, primarily in the context of modern welfare states. Based on both normative theory (particularly the capability approach) and empirical evidence, the authors identify the injustices of child poverty, showing how it negatively affects the well-being of children as well as their whole life course. But child poverty is not 'given by nature'. It is avoidable (...) and there is certainly the moral duty to alleviate it. Therefore, Graf and Schweiger develop a normative theory of responsibilities, which clarifies the moral role of different agents in the poor child's environment: the family, the state and many others, that have so far been neglected in philosophical theories. They conclude their book by sketching how their theory can be extended to global child poverty and what it means to show equal respect and concern for every child - no matter where and in which context they were born. The concept of implicit definition has played a central role in the controversies about the foundations of geometry. The history of this concept, however, exhibits several important confusions. The term has been used in at least three different senses—Gergonne's position, Hilbert's position of the so-called definitions by axioms , and that of Pasch and Dubislav in the sense of Russell's contextual definition. Frege's contribution to the explication of Hilbert's view has occasioned an adequate appraisal in recent years. A summary account (...) is given. The main purpose of the paper is to present some details about the historical development of the transfer of Gergonne's term ‘implicit definition’ to the Hilbert position, a transfer which goes back to the Peano School and was disseminated by Enriques. This paper is concerned with child poverty from an ethical perspective and applies the normative concept of vulnerability for this purpose. The first part of the paper will briefly outline children’s particular vulnerability and distinguish important aspects of this. Then the concept will be applied to child poverty and it will be shown that child poverty is a corrosive situational vulnerability, with many severe consequences. In this part of the paper normative reasoning and empirical literature will be brought together. Then, (...) the next section will establish why this increased vulnerability of poor children and the harm to their well-being and well-becoming, which they suffer for this reason, are of ethical concern. It will be discussed that child poverty is a structural problem based on social, political and economic factors. The concluding section will then briefly outline why it is imperative to protect children from the vulnerabilities associated with poverty. (shrink)

Through present time we’re experiencing, as in intellectual discourse also in everyday language, one truly inflationary use of the notion of culture. If almost everything can be marked by the name of culture, then the notion and the object lose their diagnostic and analytical ground. This elaboration attempts – through the work of Max Weber and the recent philosophical anthropology – to explain that culture is one anthropologically founded, socially basic fact without whose involvement there is no possibility of individual’s (...) life nor is understandable history of development of people, nations and societies. In the background of such re-defining, regarding the understanding of culture, with their actuality, are certain questions, e.g.: clash of cultures ? Can there be any multicultural society? Is there a need among societies, peoples, nations for one “dominant culture” as a necessity for their survival? etc. (shrink)

This paper is based on the assumption that the high incomes of some professional sports athletes, such as players in professional leagues in the United States and Europe, pose an ethical problem of social justice. I deal with the questions of what should follow from this evaluation and in which ways those incomes should be regulated. I discuss three different options: a) the idea that the incomes of professional athletes should be limited, b) the idea that they should be vastly (...) taxed by the state, and c) the idea that there is a moral obligation for the athletes to spend portions of their incomes on good causes. I will conclude that in today’s circumstances there are good reasons to advocate both option one (limitation) and option two (taxation), but that priority should be given to taxation. (shrink)
